Facts:
The Jury Trial began on October 20, 2008. Plaintiff claimed among other injuries, a torn meniscus tear of her right knee arising from the minor two vehicle rear end accident. Defendants argued that there was no mechanism of injury from the accident. Specifically, Defendants argued that problems to Plaintiff's knee preexisted prior to the accident date.
Defendants utilized Dr. Hillel Sperling to review Plaintiff’s medical records and also retained Dr. David Dainty of Vector Scientific to review the biomechanics of the accident. Dr. Sperling testified at trial. Plaintiff had Dr. Marvin Petruiska testify at the trial.
Result:
The verdict was reached on October 27, 2008 for Plaintiff in the amount of $3,012. Of this amount, $1,612 was for special damages and $1,400 was for general damages.
Pretrial Demands/Offers:
Defendant’s 998 Offer to Compromise: $5,001. Plaintiff’s 998 Offer to Compromise: $25,000, which was a policy limits demand.
