Facts:
Security Officer claimed he was discriminated against due to his race when he was not promoted to Sergeant. It was argued in opposition that the employer in the past had promoted persons of the same race, that past promotions of security officers revealed that persons representing a wide variety of races had been promoted, and that a candidate with superior credentials was selected.
Result:
The case was dismissed.
